i think the only way you can do this is if you have proof that he was your father, perhaps he signed your birth certificate or there is a paternity test thats been taken, if he has a will and you are not in it and you have the proof you can protest the will...probably will have to take it to court

The short answer is that you need to contact a lawyer.
The slightly longer answer is that if he does not have a will, you most likely have a claim on some of his property.
The yet longer answer, as with most things in law, is that it depends. States have laws for what happens when someone dies "intestate," that is, without a will. If there is a will, property is usually (but not always, for a variety of very technical legal reasons that vary by state) distributed in accordance with the will. If there is no will, then the laws for intestate death kick in and they provide some default rules about how property gets divvied up.
The intestate death laws will say something like "property passes to the spouse, and if the spouse is not living, to the children." There is no requirement that the children (legal word is "issue") know the person who died, like him, or care about what's going on. It doesn't matter if you don't want the property -- you'll get it anyway and then it's yours to do with as you please.
