Sgoldpers, this is an interesting point. I think it applies to " All persons" under US Jurisdiction.
Otherwise the Guantanamo prisoners would not have standing to bring their case before the court.

It is the interpretation of the Constitution by some that is helping the Enemies of America. The rights allowed to citizens, legal residents and visitors should not be extended to the enemy.

This is a guilt trip tactic used to guilt trip people into line. It's used by Bush and the boys as a key tactic to keep those against Bush and terror silent.

In fact it was first used and perfected by the Nazi's. In fact look at the quote below, you'll notice it sounds just like you

The Constitution doesn't apply to "all people" by anyone who understands it clearly. It is a document of this country, so it applies to people from and in this country. Now even if you drop those amendments you will have the problems of the Geneva Convention proably getting in the way, although I don't know it well enough to get into where all the arguements would be caused.

Sure, if you want to throw out much of what this country was founded up, go ahead and try to repeal the 5th and 6th Amendments.

Just be prepared for armed revolt if you succeed.
