What about any other mental disorders? What does it mean to be out of touch with reality?

She had six to eight weeks of daily counseling at a hospital for the PTS disorder. She came from an alcoholic home and sexually abusive father. Should she continue to be punished by having her kids taken from her? By the way, she has successfully taught school for l5 years and has her Masters Degree. The father in the custody battle is a controlling type with an anger issue......went to anger management....he hides behind being a VP of a company and a college degree and seems to others as "under control and stable." But he is not. Could this couple lose custody if they are both unfit or what? I have seen worse cases in a family and they still get the child.

First get a good lawyer and ask them that question, I sure it will not be the first time they have ever heard it and will be able to answer you from a legal standpoint. You can set up an appointment for a free consultation.
Have you ever been reported for negligence or abuse? The court will always decide on the best interest of the child.
However depression and post traumatic stress are pretty low down on the list of mental illnesses, there are MANY others that would be more threatening to a child. Don't let the threats scare you, get the advice you need and ignore the BS from him.
Also you could have your doctor that diagnosed you write a letter that you could keep on file with your attorney stating your exact mental health and if it would affect you caring for your child. That way if it seriously became an issue you could be prepared and your doctor could even testify if it came down to a court room divorce.

Out of reality means exactly that, one cannot understand the world around them, nor make everday rational decisions, basically lives in a fantasy world. The mental disorders basically depend on what type exactly and the degree of severity. If the depression os stress or whatever borders on suicidal or close,then custody wont happen. A mothers custody usually depends on drug or child abuse, so drugs used to treat the above could play a big part of it. Treatment plans could also affect the outcome. Under special circumstances, the judge could award temporary custody to another family member withholding a permanent decision to a later date to see how the mother is doing. Alot of his decision will ride on her drs report on her condition. Hope this helps and good luck

If a mother who is diagnosed with any type of mental illness has to go to court, they may bring it up but if that said person has been on medication and not hurting the children, there should not be a problem. However if the said person isn't seeking help and hasn't been on medication to control the problem then the court will see that said person as an unfit parental unit. Or order the said person to get medical attention and then to come back after a period of time to try to get custody .

If she is receiving treatment and the mental health professionals treating her are willing to testify on her behalf - then probably not. It would also depend on if the father or person seeking custody presents a good case to prove they are capable of providing a better living situation. Custody is always a crap shoot when you through the judge in the mix.

Perhaps the closeness of the child parallel with the treatment would cure the mother fast.

Yes she can, because if she is a danger to herself or the children, then it is up to a judge to determine what is best for the child

TAKE YOUR MEDS AND BE PREPARED FOR WAR, ESPECIALLY IF YOU HAVE WELL MEANING ENEMIES
