As a manager of a resturant, is it proper to ask a prospective employee during an interview if they are a Yankee Fan? If one slips in by mistake, is it okay to discharge them? In my state, you do not need to have a reason to fire someone.

One must be very careful on what one asks during an interview. It is usually best to stick to the weather. Anything personal such as asking when you graduated, or inquiring what type of accent a person speaks with is dangerous and could be interpreted as being discriminatory. You don't need a reason to fire anyone anywhere, this is called "employment at will". An employer can fire anyone for any reason or for no reason at all, so long as it is not discrimination based on gender, race, disability, religion etc. Yankee fans are not protected. However the employer cannot specify that you have to be a non-Yankee fan to work there, unless being a non-Yankee fan is essential to the job. I can think of no employer where this would apply, except maybe The Mets.

I dont think u should fire someone for being a yankees fan. I myself luv the red sox and if i am a the manager of some resturant and the person im about to hire happens to be a yankees fan, i would really care. As long the do a good job at my resturant. I'd be piss if someone fired me just because i was a red sox fan. I'd sue there ***. But your the boss....

It's not only whether the suit would stand up in court, but it's also whether you or your company would agree to settle out of court. Either way, your actions would cost your employer money and probably result in terrible publicity.

Hire people on the basis of whether they can do the job at hand.

Someone mentioned that it might be okay for the NY Mets not to hire a Yankee fan. He missed the obvious--the New York Mets not only hired a Yankee fan, they hired a lifelong Yankee, former 2nd baseman and coach Willie Randolph as their manager! He is now leading them to their first division championship in 20 years. They didn't care where he was from and where his passions were; they knew he could do the job.

If someone did slip in as a yankee fan, and were caught rooting for the yankees in any fashion, they were would fired on the spot!

If you have no interest in having a career yourself, sure why not?

If you do not want to be sued and have a ruined reputation for firing someone for an asinine reason, I would not fire them.

However, you would make the workplace more interesting and exciting if you did hire a fan of another team (Mets or BoSox?).

A ittle bit of rivalry like this can make the day more fun.

You know that wouldn't be ethical. But alls fair in love and war. A true Yankee fan wouldn't want to work for your sorry asc anyway. Better luck next year, Red Sox!

Guess it would depend on the business. If it was a cafe @ Yankee Stadium...i'd say...yeah.Other than something like that i'd say No...if your in a at will state....you do not have to have reason.
But, i'd even let a Yankee's fan serve me a Big Mac......lol

It isn't ethical, and I believe it would still be illegal to ask them during the interview.
I just want to add being unethical doesn't make it illegal. In a State like that you can fire them as there is no equal opportunity that protects a team's fans.

Better to fire someone for no reason than for retaliation or bias.
If you are in an at will state, then you can hire and fire at will, but to list something as petty as this?
You are a lawyers dream if a lawyer wanted to sue.

What are you a Red Sox fan its not your fault that they blown and choked their chances to get to the playoffs.Besides Boston sucks anyways are you a manager for being a major asshole or a manager at TGI Friday or Pizzeria Uno.To me I think you are very unprofessional human being.
