Prison sentences?

How likely is it for a prisoner with a Class C felony in NY to be relased after serving less than 3 years, if the minimum relase is 2008,Max is 2010, and earliest release is 2006?

If someone is in for Marijuana possession,Class C, and prior to this had been in jail on and off for over 5 yrs on Class E or D offenses. How likely in NY will they be relased early for this, if they didn't serve their minimum yet?

It honestly depends on the person. What is the record of prior offensences?behavior while in prison? or even the charge that they are in on now? ALOT of factors go into early release. Parole Boards are becoming more strict because they are trying to stop people from re-entering the prison system. The repeat offender stats are very high if they are let out too early.

With the overcrowding of the jail system, they have to release some prisoners to make room for the "worse of the worse". Not sure about anyone else, but I'd rather have a felon on the streets snagging purses or stealing cars rather than a multiple rapist, child abuser or murderer back out with me.

There are alot of things that need to be taken into consideration on this ,"early release" due to, "good conduct time", downward departures for testifying, or some sort of cooperation with law enforcement. would need to be considered To be perfectly honest , if they're not a "snitch" early release is not very good.

Here in Canada its 1/3 of the sentence if your on good behaviour.

You didn't say what the conviction was. In my experience, sadly violent criminals are let out while someone with an ounce of pot is locked up.
