My question is a friend of mine has 2 children receiving death benefits, the social security adm, completely screwed up her checks, she is to receive 600.00 per child, and is only receiving 400.00 per child, she has been going around and around for almost 6 months. They finally told her that they would cut her a check for differance not recv'd and it would be her by the 1st, she had to go back down again on 12th, now they said it will take an additional 3 weeks maybe if she is lucky, Doesn't they owe her penalties for holding her childerns money so long?

And is there a time frame for inwhich they have to become current on payments? I have searched every where on thier website and found nothing. It seems if there isn't then they could wait 5 years to pay and that doesn't sound fair or right.

If this is the USA, then have your friend contact her Congressperson. The SS Admin. has to reply within three days and fix the problem ASAP.

No. All they are obligated to pay is the amount due and not yet paid.

Social Security doesn't owe penalties and you can never absolutely predict when they will send a check until it's actually in the system.

they will continue to jerk her around without legal help to learn her rights. A legal aid office should be able to help for either free or small fees. The problem is not what the SSA is supposed to do or what they say they will do it comes down to what you make them do with force through knowledge. My friend had the same prob and they screwed up for so long she was evicted with 4 kids when they owed her thousands, one letter from her lawyer and it magically resolved. Another good place to get help is your local congresman and senators, drop them an e-mail or letter and it can be very effective. Good luck!

Maybe it would be right for them to pay penalties. But I believe they just pay you whats owed, when you finally get it.

I believe that they would have to pay her retro. They are not an insurance company. So I dont believe that they will have to pay her a penaltie.

I hate to tell you this but know they don't owe her any penalties. they can srew up but we can't. I really fill sorry for her and her kids.
