I had no clue this would happen. I am trying to figure out what my liability is in this situation. I offered to help remove the tree and see what damages if any have occured, but my neighor says no way. He is emphatic about me paying to have it done. I offered to share the cost.....still no way. After offering several suggestions to right the situation I am now pissed off he is being so stubborn. Do I have liability do pay?

A falling tree branch, unless the fall was caused by something you did, is an act of god, and the general rule is that the owner of the land to which the tree is rooted is NOT liable either for its removal or the damage it causes.

The neighbor could have cut and removed any branch that overhung his property, but chose not to do so.

your tree, it fell, yeah you should pay. of course try to get your insurance to pay, but you are responsible

I believe that it is the responsibility of your homeowner's insurance.
