I dont know where you live but I live in montana and my ex husband has physical custody of our son. HOWEVER, we both share joint legal custody which means ANY decision regarding our child has to be discussed between us before it is done. If it is an emergency child comes first once we get him to the ER then i call his dad and vice versa EVERY SINGLE TIME. I hate his father but we do what needs done for our CHILD. Legally I have as much right to know about my sons medical, dental, schooling, and anything else I wish to know about and my ex or my sons doctor or teacher or whomever HAS to tell me. We worded the parenting plan exactly for this reason. I stay a very active part of my sons life even though he doesnt live with me.

What does your living in another state have to do with your daughter being in the ER? Your ex is still her other parent, and if you can make it there, that's a good thing. That has nothing to do with your relationship. You need to put aside your differences for one night and focus on your child. If your ex doesn't tell you right away, that may be because he/she wanted to have something to tell you without having you freak out over the fact that she's in the ER at all.

This is dependent upon the details in your divorce decree. Do you share custody? If so they must inform you right away. In the state I live in if a parent has sole custody it is totally up to them if they share this with the non custodial parent. Try talking with your ex and explaining you only want what is best for the child and would like to be informed so that you know what is going on.

It really depends on what your court order says in notifying the ex of an emergency room situation. However, if it does not even mention it, it would be nice to tell him in case he wants to be there in the ER for your daughter.

I call my ex if my son is even slightly ill, although I can do all medical things without his consent or notifying him as I have residential custody, but out of concern for your child, she/he should contact you, its a matter you being a parent, whether or not you get along well or not. It is legally a matter of your custody paperwork though, but its not very nice to withhold that kind of info from the other parent it doesnt make sense

whether the law says yes or know morrally she should let you know. You are the childs father and because the two of you arnt together doesnt mean that your child should not have the suport of both its parents when it is unwell............... ppl leave you children out of your relationship problems unless its life threatening to them
