Isn't the ACLU anti-american...by not signing the pledges, doesn't that help terrorists...how hard is it to sign a pledge...what harm does that do...exept it isn't PC enough for the ACLU...

Because it's a triple constitutional violation.

First, it's a violation of the 1st Amendment freedom of assembly. Under Constitutional law, a person cannot be guilty just for associating with someone else who commits a crime. The requirement for "have no involvement with" is a violation of that rule.

Second, the "no involvement" would also violate the 6th Amendment right to counsel, because it would required attorneys to refuse to defend people accused of terrorism. And because everyone is presumed innocent until proven guilty, such denial of counsel is another constitutional violation.

That second provision was what the court meant when it ruled that "requiring the pledges from court-appointed attorneys fell outside of the act’s definition".

Finally, the Constitution prohibits compelled speech, except for an oath of practice (or office) to support and defend the constitution and the applicable laws. That's been settled law for decades, since the attempted loyalty oaths in the 1950s. So, the forced oath a constitutional violation of compelled speech, in addition to the other constitutional violations above.

Besides, every attorney has already sworn to uphold the laws, to obey the laws, and to act with candor to the court. Making them swear another oath that they won't break that specific law is redundant, and offensive. Just like forcing a policeman to swear that oath would be redundant and offensive.

So, no it's not Anti-American to follow Constitutional requirements, or to object to wasting time swearing to do something that's already covered by existing oaths.

On the other hand, how does signing the act make things safer? You think it will stop terrorists from terrorism? I don't think it is a good measure and agree with the ACLU that it only produces more paperwork, unnecessary paperwork. Now as far as I know, anything unnecessary will not likely yield much result. Only that politicians can wave a couple of million signed pieces of paper, with which they give you the impression that things are safer. Imagine if that could ever really be the case!

Maybe you should reverse the question. Do you really think that signing the pledge form would really stop terrorism?

Terrorist: "Darn, I can't blow up the building because I signed a pledge form."

The legislation was totally bogus and a waste of time.

What the ACLU fights for are the freedoms defined in the constitution. If the government didn't pass stupid laws, it wouldn't have to waste time in court.

Signing a statement saying that you are not a terrorist and you do not support them is an assult on American civil liberties? That is rediculous.

If a lawyer is a terrorist or supports them, then he is a bigger threat to my civil liberties than any signature is. Being/supporting terrorists is a crime in and of itself. They could just lie and sign the paper. If they get caught, does it really matter?

I'm not sure if the ACLU is truly anti-American, but it seems like what they fight for, more often than not, is detrimental to American society. It also costs the government a lot of money to have to keep fighting these pathetic court cases.

I must emphasize that I WHOLEHEARTEDLY AGREE with the answers beginning with birdsnakecatharine down to fr_chuck, and anybody else's who realize that the ACLU is North America's equivalent to the Nazi's and Soviets' secret police who try to drive God out of our country and destroy our nation, and the idiot, KFCEQUALSFATTYBOTTOM's answer is a perfect example of the perversion of those who don't and WON'T realize that. I was given a way to most appropriately reply to the ACLU this Christmas, and that is for as many people as possible to send the ACLU a Christian Christmas card. Don't ever expect the ACLU ( All Communist Lawyers, United ) to do anything to actually protect the interest of the people of the United States. They are much more concerned about the 'rights' of those who are trying to kill us.

since its inception, the aclu has defended the rights of criminals and deviants. I knew someone who called it "The American Criminal Liberties Union".

I feel that if I, a white male, were to file suit with aclu, they would ignore me. They are anti-american, anti-christian, anti-white, and extremely liberal.
