Does anyone (Law Majors,Lawyers etc) know the DEFINITION/and or Interpretation of "Illegal Sex" I told my friend I said it falls under the term "Unlawful Sex" mostlly prostitution which is illegal and unlawful,so I said what are you getting at,since I know him, so heres his story,hes been separated from his spouse for about 1 1/2 yrs,both living apart,he met this girl clubbing awhile back and hes all worried about his pending divorce if they will consider him dating this girl and having sex ,will be considered "Illegal sex" per say ,I guess it would be considered "Adultry",but the thing is , I found out, she's was separated from her spouse also at the time,now she went back to her spouse but he's SOL ....so my question is ,if both partys were separated from their spouses, when they had consentual sex ,is that considered "Illegal sex"?there was no legal filing saying they were legally seperated on his part, I hope this makes sense because now I 'm all confused,thanks

Sounds legal to me. May be bad for his divorce case though.

I'm not a lawyer, but I did a few searches on "illegal sex definitions", and found some quickie definitions (no pun intended!).

"Illegal Sex" usually refers to prostitution. It can also apply to certain illegal forms of pornography. Sex with someone who is either unable to give consent, or not of legal age, is also illegal.

Unless your friend paid for sex, the term "illegal sex" does not apply in his divorce case. "Adultery" is another matter. Without the marriage being legally dissolved, and depending on where he lives, his (estranged) wife can use the adultery arguement in her divorce case.

Bottom line: Consensual sex between 2 people of legal age is not illegal unless money or rewards changes hands (payment).
If he slept with the girl he was dating during his estrangement, he is guilty of adultery. That is only "illegal" if he is a member of the American armed forces.

I believe that illegal sex is considered when some one has sex with an under age child.You are right, adultery is when you are still married to some one but you have sex with somebody else than with your spouse.Even if you are separated from your spouse.They both have been separated but they did adultery by sleeping with different people.

Well with him not having any legal backing as far as Legal Sep papers that may cause a problem. Now I know in a few states that if you are dating someone and do not have any documentation stating "legal" separation you can be charged with stealing someones affection and its a real Law and it has REAL penalties. If you are 18 sex is legal - below not legal. Sex has no limits if both sides accepted and want. Only in Middle East tradition man can fak but women can be kill for doing so.

Absolutely not especially if they were seperated. Now in my case I fell in love and ended up living with this person and during the divorce I was docked on my alimony because we were living together....but it's not illegal...

I guess that illegal sex would be sex for money or sex with minors. Or of course unwanted sex in which the word no was used.

adultery is not considered "illegal sex".. it is grounds for divorce and perhaps a larger settlement for the other party.. but in no ways is it "illegal".. ur friend is an idiot and should consult his lawyer.
