Because he doesn't believe the law applies to him. He keeps saying in signing statements, opinion memos, legal briefs, etc.
Read the signing statement linked below. Bush keeps repeating the phrase "unitary executive branch" which is a reference to the legal doctrine that says the executive branch has sole and exclusive authority to act outside the scope of any laws or court rulings.
Check out the references to sections 8106 and 8119, and section 1005. Bush is flat out rejecting the authority of Congress to make laws regulating the armed forces (Article I Section 8), and rejecting the Supreme Court's authority to hear habeas corpus cases, which the Supreme Court has repeatedly asserted.
Bush just doesn't think he is subject to the law.
