they were in cps but know they stay with their aunt and another with her grandmother cps gave them custody but my parental right are not terminated. and its been three years since the case and i just found out that the same person who handle the case will have to reopen the case and she was more on their side then mine. so what i'm trying to say i want my kids back and i will have to get a lawyer to open the case and i don't have money for that.

Not known why they were taken into cps and not knowing which parent you are and what about the other, makes this hard to answer but will try in general terms and hope this helps before you obtain an atty. If the kids were taken because of you, you will have to prove to the court beyond any reasonable doubt that you have changed and this isnt going to be easy. Any medical records, friends wholl testify as to your integrity, personality, etc will help. The courts didnt terminate your parentalrights due to the fact that hopefully one day you might get custody, but in the meantime the courts and cps will put the kids with willing relatives first before outside foster families.You will have to prove that you have become a better environment to live in than what they have now so cps wont have to intervene again later. You will have to have a steady income and residence even before the courts will rehear your case. In other words its to you totally to change the courts mind. So think about this and make sure you can do it before dishing out money for an atty and having him/her tell you the same thing. Good luck

if you dont have money for lawyer, you probably are not stable enough to have the kids.
