In our divorce decree it is stated that my ex husband is responsible to pay all debts and get them out of my name within 60 days. My credit is also not to be affected. Well he has not been paying and he has not been paying the child support I lowered so he could pay everything. i have no money to get a lawyer. What should I do? PLEASE HELP!!!

You need to file a motion with the court to (depending on your state's practice) order him held in contempt for failing to make the payments; or order him to comply with the court's final judgment or show cause why he should not be held in contempt of court for failing to do so. You CAN do it yourself, but it will take a lot of self education in learning how to prepare the form & how to file it & give notice & set the motion for hearing. You are better off getting a lawyer even if you have to borrow to pay for it.

Your child support should be being handled by your local Division of Child Support Enforcement (although it may have a slightly different name where you are). You may want to contact them to get them to start the ball rolling on enforcing the support. You may have to pay them a minimal (in DE it is $25) fee to represent you if you are not on welfare.

You may contact your Community Legal Aid Society (again, it may have a different name where you are) for legal assistance in other areas. You can also go back to the Court and file a Motion for Rule to Show Cause (that is what it is called here -- check with the Court in your area for details) so your ex will be brought to Court to say why he is not following the Court order.

Talk with legal services they might be able to help you get a lawyer free of charge to take this back to court.
