The awning that hit him and knocked him out was indeed my awning. I hesitated for months to fix it but now I have no choice thanks to him. I called for the ambulance and told them that a branch which I strategically place near the scene had fell and hit him in the head. Now that he is back from the hospital he is questioning what had happened. Should I tell him the truth knowing that I can get away with it or should I tell the truth and be sued. Just so you all know I will NOT tell him the truth.

Regardless of the awning OR the branch - whichever hit him, it was from your property and he CAN SUE YOU.
So you better get your story straight, because the doctors can most likely tell from his injuries that he was hit by an awning, and not a tree branch. Not only can he sue you for getting hurt on your property, he can also sue you for negligence since you knew it needed to be fixed.
And lying in court is called perjury, and it carries its own sentence. Sir, you are royally screwed.

How can you live with yourself? Why don't you tell him the truth and offer to pay his medical expenses? That is the right thing to do. By taking the dishonorable route, planting "evidence" to exonerate you and lying, you have now opened yourself up to criminal prosecution, in addition to the financial aspect of being sued. It's possible your neighbor really does remember what happened and is testing to see if you're a decent human being or a slimeball and will opt to sue based on the choice you made.

Well, if he doens't know and you're fine with keeping it a secret, I don't see why you should cause this potentially uncomfortable situation between you and your neighbor. If he has to pay a bunch of medical bills on the other hand, and you have insurance that would cover him, I would tell him, but I would do it over a case of beer.
