they why is it discrimination to not hire someone that cannot speak English clearly? If accomodating those too stupid/lazy to learn the language can be a job requirement, why can't it be a requirement that a person speak the language of the country properly?

It is discrimination to not hire someone that does not speak spanish fluently. But, it is permissible discrimination if that is what the job requires, just like if an employer doesn't hire you because you have a rotten attitude, that is permissible discrimination if the job requires a good attitude. It is also permissible discrimination to not hire someone that cannot speak English clearly if that is what the job requires. In the context of your question about "ebonics" you seem to be generalizing a race and it is not permissible to refuse to hire someone based on race.

It isn't discrimination if being fluent in Spanish is the job requirement. If you don't speak Spanish learn it or don't apply for the job. And not all people who don't speak english are stupid and lazy, and that was not fair for you to say. English is one of the hardest languages to learn for a foreigner, and you don't learn it overnight if you're an adult. Not everyone was born in an english speaking country.

Actually, it isn't discrimination to not offer employment to someone who can't fluently speak english.

All an employer would have to do to avoid a charge of discrimination is spell out in the job description that good written and oral communication skills in the english language are a pre-requesite for the job.

Plenty of Americans born and raised don't speak English (with English being the only language they speak)properly either. Rarely have I dealt with anyone hispanic who did not speak English well when it was the main requirement for their job. I have however, had many problems dealing with customer service who's employees are from India and I can't understand them and it's very frustrating.

Since when did not getting a job due to not speaking english clearly become discrimination?
jobs have certain requirements and those requirements need to be met as long as they are within our laws.
Deaf and Dumb people should not be discriminated either!

In order to get the best person for the job, you must discriminate. Laws that we have now make an employer so afraid to hire who he wants for a position, that they don't necessarily hire the best person. Every business the government has gotten into has been nearly impossible to run.
You want to hear discrimination? The ICAO sets the standards for licensing airplane pilots. In order to get a pilot license you have to speak English. Go to any country, and the pilots are speaking to the control towers in English.
