My wife initiated a divorce action in November 05. My lawyer requested final hearing....granted for October 20, 2006. Both of my teenage sons have been taken from their mother and placed into state custody.....and will not be released until at least one month after final. My attorney is 81 years old and has multiple sclerosis, and his wife is in hospital near death.....and he is not physically ready for trial. I do not want to do anything until my children have been released, and reports from their social workers/counselors have been received. Should I have my attorney petition the court for postponement.....should I petition?
My attorney is only doing this as a favor to me...my sister works for him....and I could not afford a "real" attorney when this action first started. We have 3 pieces of real estate and other property valued in excess of $300,000.00.........please point me in the right direction.

You might try asking your present attorney to point you in the direction of another to handle your case quickly...or just get out the yellow pages man and get someone who offers to take your case. Try calling the state board and present your facts as above and they will have attorneys call you for a 30min free consult.
If your teens are in state custody, you might want to really consider getting an expert in this matter so as to get it right the first time and not have your kids shuffled around. Wow, tuff one.

Why would you postpone if your own children are in state custody until this is all final?

Your priorities need some readjusting buddy. Sell off part of your property and get your kids HOME.

My god, why could you not afford a 'real' attorney when you own real estate valued in excess of $300,000.00?

talk to your lawyer because he should put in a postponement
