I am going through a bankruptcy and debts, Inland Revenue, council parking fines for previously owned vehicles registered to home and other family addresses. Not to mention being chased by credit card companies, mobile phone etc. to whom I also owe money.

The baliffs came yesterday and threatened forced entry and removal of possessions. My parents told them I no longer lived there and nothing was in the house belonging to me. They were told that unless they pay (which they did on this occasion) property will be removed and the onus is completely on us to prove it does not belong to me.

Clearly its a very unhappy situation to have one's family drawn into one's independent financial circumstances (brought on by a failed business venture and poor health preventing me from taking a 'regular job' although I have never, neither will claim state benefit) I am considering bankruptcy and need to confront my creditors not least to stop my family being harassed. Anyone with experience?

I dont think that sounds legit
The debt is owed by you not your parents, so it sounds like the baliffs pulled a fast one. Its probably true to say that your parents woudl need to demonstrate that goods were theirs not yours, but Im guessing that shoudl be realtively straightforward, especailly if there is no sign of yoiu living there, and there are no duplications of goods (eg if your parents had a widescreen TV in the say 2 rooms).

They cant force entry without a court order, and iI think to do that they need to have the police present

I'd suggest that your parents talk to CAB immediately to get a clear understanding of what rights they have to refuse entry, and what steps they must take to stop it happening again (make sure all doors & windows locked, never let a Baliff gain entry (once they have gained entry it seems liek they can then break in to seize goods (although I'm guessing that is once they have identified goods that are owned by the debtor)

They should, or you should immedaitely reply to any letters pointing out that you dont live there anymore and that there are no goods that can be seized. Obviously they will want a new address

BTW it may be a good idea to be very circumspect when seeing your parents. as Baliffs could be tracking you via your parents.

it all depends..
if it is a magistrates court bailiff then they can enter your parents home, using a lock smith if they so wish,
however,
if it isn't they can lie and bully (they will by the way, they are by no means nice people) but can not come in, unless...there is an unlocked door/window/open door/window, that is seen as "passively" seeking entry
also if your parents let them into there home, he now has the right to enter it again without permission
if they do enter, your parents need to show some kind of proof that nothing in the house belongs to you, weather it be by way of receipt or ownership documents etc
RING the national debt line, they can tell you exactly what you can do, also the citizens advise can do a "budget" for you, allowing for all your incoming and out goings, then they will write to all these people by way of a "holding" letter, they have the power to stop those company's from harassing you, giving you time to get back on your feet and finding a way for yourself to slowly pay back the money in a way and time frame that suits you and your income

I have no experience personally but my good friend was in a similar situation.
If you are paying council tax at that address then it is classed as 'proof' that you reside there.
The bailiffs have every right to enter a property you are registered at in order to take away goods.
Your parents are expected to offer information as to your whereabouts to try and avoid their goods being taken.
If the bailffs believe that you are no longer at that address and that your parents are not responsible for you then they 'may' decide not to enter the property but most don't and won't.
Your parents have no right to deny access as this has gone this far.
I don't understand how anyone can leave their parents to pick up after them however. You should not have let this get this far before considering bankruptcy. Do it immediately or try and speak to the authorities involved to try and come to some amicable solution.
If you are indeed very ill, too ill to work then you may have to swallow your pride and accept benefits (if you are eligible).
It's a ghastly situation to be in and to your family in but get as much done as you possibly can and as soon as possible. No-one else will help you except yourself and your family (before their patience runs right out).

hello OK now listen first of all if a bailiff forces his way into you re property he cannot do sow without a police officer present and a court letter the only way that he may enter you re domain is for you to let him inn you re house .second if you go bankrupt it will do no good to you re preface address is still as you re where living there at the time the action was taken by the bailiff the thing for you re per ants to do is to write to the courts and ask and prove that all possessions are there's get a friend to back date all listing thinks in the house and say they own them OK i hope this helps

They cannot force your parents to pay nor can they remove things from their house. I do think that bancrupcy is your best option. You pay £380 which covers all court fees etc and all your debts are removed. You will however have to pay a small amount back for about a year but this is minimal dependant on what you earn etc........good luck
