If what you say actually happened and you can prove it, you should definetly go to a lawyer with the information. Do not let the boy get away with what he did because it sounds like he has some serious issues, even though he is young he can be a predator. The only way to stop them is to act as soon as it happens, otherwise you will be letting this happen to someone else inthe future. This is definetly a legal matter, don't hesitate on this one, the longer you wait the worse it will get.

On the facts you provided, no...at least not in New York. And while the laws regarding defamation vary from state to state, I doubt any would allow you to sue, for the following reasons:
1. The statements of the parents were not about you. Therefore they are not, as to you, defamatory. (I'll get to whether a suit could be brought on behalf of your children in a moment.)
2. The statements, as you relate them, appear to have been in order to either get medical attention for someone or to file an official government report. Both are protected, even if the information is false, except under unique circumstances that vary from state to state.
It is that second reason that makes it unlikely that a suit would be successful on behalf of your children.
I know that's not what you want to hear...but that's how I view your case.

By all means go to the police and file a report. Get social services to check out this family as well.
But ask yourself whether you want to drag this out for your kids' sake. Do you have proof that the neighbours' kid is guilty, if not, its a case of your word against theirs. it would add salt to the wound to take it to court, make your kids relive the ordeal over again, and then lose due to lack of evidence.
Bottom line, both your kids and the neighbours' need a stern talking to. They should know what to do in such a situation- to walk- no run- away once they see some signs, or to scream or yell for help.
There are sick grown-ups out there who do the same or worse to kids, so the best thing you can do is prepare them better to avoid this hapenning again.

get an attorney and see what they say, call around to different offices or call the aclu as they may be able to help or refer you to someone who can. there are also lots of attorney's that do pro bono work if you can't afford it. if all you say is true this a disturbing case and one you really need to pursue until you get justice for your children. it sounds too like the mother of the 8 yr old probably knew it was him and was trying to deflect attention from him especially since she thought to make the rounds of the neighborhood to let everyone know...its really despicable what she did and you and your children deserve better.

Probably not. If DCFS had to get involved and they found enough evidence to warrant therapy for your kids then it probably happened. Many parents would like to believe their kids can do no wrong even if they have a homicide conviction.

its not that the other parents need to suffer. their kids must have learned it somewhere. makes you wonder if they arent being abused doesnt it?
get to a lawyer and camp on his doorstep if need be

defamation? im no lawyer but thats what it sounds like. if they go to your neighbors houses and say they did it when they are still innocent (innocent until proven guilty) then I would think you could absolutely sue them.
