OMG you guys!!! youre not gonna believe this!!
So, in my previous question, my checking account was mysteriously overdrafted negative -$102.80. i kept lookin at my statement and studying it and i know i didnt spend that much nor overdrafted it because i was keeping record of everything. i saw one item on my statement that said:
9/14/2006 depositied item returned..
i kept thinking..i didnt spend 50 bux on anything within the last few days so what could that be? i kept thinking and i just remembered that i babysat for this family that had money problems.. well, the mom took over 3 weeks in paying me for watching her two boys. she finally gave me a check last week for $50.00.. that is the only thing i can think of. her check bounced!!! now, my account is overdrafted because i spent money that i thought was there! the bank charged me $34 x3. should i have the woman pay me the 50.00 that bounced, or should i have her pay me wat bounced PLUS the overdraft fees it costed me?

You could charge her the whle amount legally but I think realistically you wouldn't get much more than the $50 if you get that at all. You should tell her about the problem and never babysit for her again you get the $ up front in cash.

Send a letter to this person clearly stating that she has ten days to make good on her check plus twenty dollar charge for righting a nsf check. If payment is not recieved in ten days this will be forwared to the maistrate for processing. Then make sure you put your contact information on the letter.Send the letter with a return reciept from post office. As far as your bank account goes you need to get balance positive quickly or the bank will keep adding new charges each day that the account is overdrawn. And don't wright any more checks until you get a positive balance in account.

Go talk to your bank. When they see that the overdraft was caused by a return item, they may be inclined to reverse the charges. Your only mistake was writing checks against uncollected funds.... It happened to me once and my bank (Washington Mutual) was really good to me and reversed $145 of service charges. Of course I'd been with WM for a few years and never had a previous overdraft situation.

Good luck!

Truthfully, I can't tell you what you should do about her. But let it be a lesson to you to cash checks you receive somewhere besides your bank, then deposit the cash into your account. If you would have done that, and her check would have bounced, it would have only been her problem, not yours too.

GOOD GIRL...you did your homework... but my method still applies as I mentioned earlier...get extra money in your account and ignore it.

Go after the person who did this to you and get extra for your troubles !!!!

YOU SHOULD ASK FOR THE $50 PLUS FEES BUT VERY UNLIKELY YOU WILL GET IT. TAKE IT TO THE COUNTY ATTORNEY, THEY USUALLY HELP PEOPLE IN THESE MATTERS.
