My husband says that he wants a divorce and is filing soon. he says it is going to be in the newspaper and he is going to re marry two weeks from the date the papers are filed. Is this legal. It is being handled in virginia

Unless Virginian law is vastly different to the rest of American and the Western World (which I doubt), then no he cannot remarry within two weeks from filing papers, and if he thinks he can then he's an idiot.

First you would have to receive the papers. Second you would have to sign them as well, which you'll only do if you don't intend to contest it. My advice would be - given that he cleary wants out very quickly - is to tell him you won't contest if he gives you a more than generous offer.

But even after you've signed the papers there still has to be a first decree (at which point you (both) still cannot remarry but are considered seperate from each other in terms of shared property and finally a final decree (normally a six months or so later, provided nobody has objected) - in England we call that the Decree Absolute.

Only once that has been granted can either of you remarry.

Sorry, divorce is such a painful experience. He is just being a jerk and is trying to hurt your feelings. Most states have a waiting period after divorce that states you must wait a number of months before re marring. Good luck to you, hopefully the next guy you find will treat you with respect and love.

Cannot see how this is legal.
The divorce has to be final for him to marry.
If you have a beef against him, let him do it and then turn him in for bigamy.
If he wants to stay within the law, an engagement ring will have to suffice till the divorce is final.
You are taking this really well.

Don't get mad, get everything. He has obviously been committing adultery, take all you can get out of him, alimony or maintenance and child support. Sometimes when there is adultery, the other spouse can get more than one half.

what's his reason for wanting to get a divorce?
And I don't know about the law in the states, but the divorce, he has to have a prove that he and you were separated for a year, in order to get a divorce. Then once the divorce is final, then he can get re-married. If he's getting re-married, when he isn't divorced yet, it's illegal.

I don't know anything about the laws in virginia, but I would just like to say, he is giving you the best gift you could ever recieve.

I don't think one can remarry till the divorce is finalized. Either way i would start looking for a good lawyer.

have you ask him why he wants the divorce? I don't think there is much you can do if he does not want to work things out you do have much chance . I dont know about thw law there call a law office and talk to some one about it .iot will put your mind at ease

HE is the one that needs to check to see if it is legal. That is not your problem, nor your business, what he does when he is legally single again.
