Havent seen him in about 3 years, since i moved out. Can i file and let the courts handle locating him? Does it still go through (the divorce) if they cant locate him? pretty sure he is in another state.We were only together for 10 months, no kids, or joint property or stuff like that.

Seriously, though, this is a major issue and you don't want to get this wrong. There are a number of options the courts may be able to pursue; but you are best getting advice on such matters directly from a lawyer.

Get an attorney. If the spouse is in an unknown location you publish notice in the legal section in three different newspapers in the area of his last known whereabouts for three weeks. That might be different now; but that is something the attorney takes care of. Then notice that publication has been done is included with the divorce procedings.

Put a notice in all your local newspapers of the Divorce For 30 Days, And if no reply after 30 days,See a lawyer. there are free Lawyers Look in your phone book. Make sure that youkeep a copy of the notices,and a couple of newspapers so when you go to court, you have it, it will help your case.

You can file under terms of abandonment. You can tell the court he is absent and request a grant for divorce from him in his absence. It's not like he can contest if he is not around. As far as getting the dough goes, you will then have to disclose everything you and he have earned/owned that falls under matrimonial property rights and collective income, then make a fair claim against him. Just sue his butt. Good luck.

it has been like 25 yrs ago that i divorced in oregon. and if the laws havent changed, all that was required was to put a notice in the paper in the last know city that my ex was known to have lived. it was pretty much cut and dried. hope this helps

You buy a spot in the public notice section and publicize that you are looking for him and you have to run it 30 days. If he does not respond, you file that you can not locate him and you use that as your proof.

Was it marriage or Live-in relation ? If married, you can have Divorce, but for that you will have to gather information about him, whether he is alive, his location if he is alive.(this can be done thru' his Social Security Number) One can get Divorce in absence of another party, provide if it is proved that he/she is living.
