Is it a job as a waiter? Those jobs are expected to collect tips and the wages are lower to offset that.

first look up the minimum wage laws in your state. This will help you find them
The part about only getting paid minimum wage if youre working 40 hours a week is wrong, that person has been misinformed.
If you work for tips, then you have to at least make minimum wage with your tips
for example: if you make 2.13 an hour and work for 1 hour, you must make 3.02 in tips to suppliment, if your state minimum wage is 5.15
- be aware, there are excemptions to the minimum wage laws

Make sure youre working legally. If youre getting paid under the table and do not pay taxes, that can be a sticky situation for you and its better off for you to leave.
If you are being unfairly paid, you can contact a lawyer, but you are not guaranteed a free one. The only time you are guarenteed a free lawyer is if you can show financial need and you are being charged with a crime and facing prision time.

Your local department of labor should be able to help you if you cannot hire a lawyer.

It is illegal for anyone to be paid less than minimum wage. You need to notify the state department of labor, making sure to include your employer's information and some proof (a check stub would do) that you're not receiveing minimum wage.

There no spectrum of illegal and legal. It's either legal or its not.

Being paid below minimum wage is sometimes legal, depending on the state. For example if they are providing you with some other benefit, you are making up for the wages in tips, or you are in a training period.

Otherwise, it's illegal. You should report them to your the appropriate state agency.
