I knew some gay people who went to prison, and they were kept in a separate area together. The gay men and transsexuals/ transvestites were together for their own safety.

I'd expect that they and their lawyer would be given sway with the court; however, physical attributes most likely would be taken into consideration as well.

In a men's prison, as a matter of law they won't put someone with a penis in a woman's prison.
