Well first of all if my husband was in prison I would consider that relationship as the ex files. I think you are trying to recapture a past that has met the expiry date. No - I do not think you are cheating because somewhere in the back of your mind you realize the relationship with your husband is over.

Who are you? What is your gender? What is your husbands gender? What are you asking?
I guess it depends on what you as a couple decide on. Perhaps you should just not bother on being married and just have a free for all. just be honest with him. To each their own I guess. Some people do not care about marriage I guess.

If you are in intimate situations with anyone without it being ok with your husband, then i would consider that cheating. Just like i would consider cyber/phone sex cheating. Or a purely non-physical, dating-type of relationship with emotional attachments. The worst part of an affair is usually the deceit, so if you are lying to him, or keeping things from him, that should basically make it an affair on it's own.
