Such harsh answers and lack of understanding of this persons problems. The information given does not tell the story behind the situation. Fixed income means different things to different people. And, no information to base your opinions on was provides as to what kind of income, or if there are disabilities, whether physical or mental. As for the situation with the mother, not all mothers are saints or easy to get along with, some are devils and crazy makers. Judgements are easy to pass and your situation may not compare at all to this persons.
First of all, in answer to your question, is your mother letting your life rent free, or is rent money changing hands and is there an agreement, verbal or written as to what the rent should be each period? If so, she must follow all the legal requirments of a landlord in asking you to move, or evicting you. Should she not do so, then you can take her to court to delay the eviction, if that is what's happening. To do so may make worse an already bad situation. So, take any action in that direction at risk.
If your income is low enough, you may be eligible for housing assistance. You should apply, if you have not, through the local public housing agency. In most locales, the waiting lists for housing assistance are long. If you can reach an agreement with your mother, maybe she'll agree to let you continue to live in the apartment until you get the assistance. Should the problem be one of you not paying the amount of rent her apartment would bring on the open market, then should you recieve Section 8 housing assistance, she may be able to receive rent payments directly from the housing authority, negating the need to move.
Finally, the other thing to do is diligiently search for housing you can afford. Its sometimes difficult to do so, and you may have to take housing in a less desireable area, but that is a fact of life. Another alternative is the possibility of looking in another town near you. I'm not from the Northest, so don't know how that would fit in with your needs as it regards work and family. Even more drastic would be to move farther away to a lower cost area.
I'm sorry, but there is no easy answer to your question. I do hope you resolve your housing problem soon and in a way that is beneficial to you.

Get a letter of eviction from your mother if you don't already have one. Call legal aid in your area and see if they can tell you where you can get a copy of the Landlord/Tenant law in your area. Your landlord must giive you written notice a certain number of days before you must move out. Thirty days is common, but depending on circumstances it could be less. You can use the letter to apply for housing/rental assistance from the State/Fed Govt. Most places you move to will want you to pay first and last month's rent plus security deposit up front.
If you've had a fallling out with your mom, you might need to grovel and apologize all over the place to gain some time. If you and/or your wife are physically or mentally disabled, you could be eligible for housing right away. Call your local state housing authority office to see what you can do.
As for your niece, you'll need to have a home to bring her to before you can get custody. Good luck.

don't you both work? what is so hard about paying rent? i own my own place on a "fixed" income. and i don't have a husband to help. just don't spend your money unnessarrily. you can always get a better job, a second job or move to a cheaper area. try buying a place. these days you don't need a huge down payment or even good credit.

Whats up with your mother? If you are paying your rent and being respectful of her then why would she ask you to leave?
