My husband and I have moved out-of-state and having been trying to rent our home. We hired a rental agency to show the unit and to take care of the lease paperork. Twice now they found someone who wanted to rent our property. Both times the day that the renters were moving in, the next door neighbor has gone over there (it's a townhouse) and wanted to know why they were peeping into his windows. He got really angry and told them that they better keep the kids quiet or he would come over and make them shut up permanently. Needless to say, they were worried about the guy being crazy and backed out of the lease. Now, the rental agency has said that they can't help us due to potential liability. What can I do about this? It is a brand new neighborhood with well off homeowners and a strict HOA. I had contacted the HOA and got all of the rules for renting. These people had over 720 credit scores and no background issues. HOA says they won't do anything.

Any ideas? Thanks in advance!

Any potential threat against another should automatically be reported to the authorities. No matter how frivolous or serious it may appear. It also sounds as though your former neighbor could use a psychiatric intervention. He seems to have a propensity toward violence and, in my estimation, someone should seek help for him.
My husband is a Psychiatrist of 35 years and the gentleman in question definitely has mental health issues-As far as the rental of your property, this situation should also be reported to the County Commissioners in the County where your property
is located - There is probably some type of law, in your state, that prohibits a person from trespassing on your property in order to stop a potential tenant from occupying the property. There is a potential for loss of revenue for you and your family.

I would contact the police, however you will need a statement, because so far it's hear-say. If at all possible get a statement from the would be renters, if not, then get a statement from the rental agency about what the neighbor said about shutting the kids up permanatly, then another statement from the rental agency about the potential liability. What your neighbor said is assault and that's illegal.

Looks like a bad situation all around. A few options for you to consider:

- Contact the police and file a formal harassment complaint agains this neighbor. Of course, you will need witnesses willing to back-up your statement.

- Consider buying him out. If this is a double unit, if you can afford this transaction, go for it (if the area has the potential of growing in market value).

- If you are not coming back to live in the area, go ahead and sell. I think your neighbor is using the harassment strategy as a bargaining chip to force you to sell.

If nothing else, consult an attorney for advice.

call the police on him when he's acting up or causing a situation.

talk to a lawyer... now that you're renting you may wish to consult one on your rights.. renters rights.. ways to protect yourself...

he's violating the law.. many ordinances of the city i'm sure and trespassing!

if you or any of the tenants can catch him in the act using video that would be superior.

get surveilance.

Sue the sob. It doesn't matter if you win or not. NOBODY likes to be sued, he'll probably back off.
If not hire me to put a spell on his butt, that will work too!

call the local police and see what they can do? also talk to him and see what his issue is.
