Ok I rent this place and the lease said if your late you pay and extra $50.00 per month well I did. Well one month I paid on the 14th and on the 16th which was a Monday at 1:30 they filed in court to eviction us. Now to remind you we had paid in full all late fees and all before this was filed. Well they droped the court date.

Well now they are still trying to make us pay for the late fees that has already been paid and a lawyer fee of $75.00.

How can they charge me for late fees I have already paid and a lawyer fee when we didn't even go to court? My lease says late fees after the 5TH will be a extra $50.00 a month. No extra late fees are stated. Should I wait till they try to evict us again and should my receipt's were I paid all late fee's or get a lawyers and charge them the fees and time off work? Please help!!!

I do have all my proof and I have 15 yrs in banking and finance. I am not a pot head and I am not a red head thank God for those two things. Of course that why you don't have any hair you burn it when you lit up.LOL If you could read you would have read the part were I said no smart A** Oh that to bad your mom smacked you on the wrong end.

I have took all my payments to the landlord and I have paid every thing up front. I have to a friend of mine who went to law school 2 yrs and they said I was in the clear.

Oh robuttox by the way I would'nt smoke something you invented. And I have to much hair to put a stove pipe on my head.

I am a very clean and orginazed person I clean daily everything. And I have no visiters. I like to stay to my self or visit at other people homes. I am not a bad person. The job I have pays late sometimes. I don't see what the problem is if I have paid. So that is what I am asking ?

Your best bet is to talk to your state real estate board. They can explain to what are your rights and in some cases go to bat for you. In any case I would consider once this cleared up moving to a new place. Make sure that you have a place in line before you give notice to your current landlord.

I hope you have a receipt for the rent and any late fees you have paid. If you do, there shouldn't be too much problem in proving you have paid the money. Otherwise it sounds like you will need a lawyer if you want to stay in this place. I'm not sure I would want to live somewhere that is so eager to evict. Is there another reason why they might want you out of there? Do you keep the place clean and neat? Do you have a lot of visitors that might be making noise? More information needed. Good luck.

I'm not a lawyer, but i think you should talk to one. It sounds like they are just trying to take advantage of you. I am in the process of buying my own home. I have a 30 year mortgage(26 left to go) my house payment is do on the 1st of the month. if we haven't paid by the 15th of the month they add on $15.00 late fees. if a bank is only going to charge $15 on a mortgage payment...then why would your landlord charge $50.00 also my husband was laid off of work for 9 months and we ended up being 2 months late on our payment...the only thing that happened was I called the bank and they work out a different payment plan that we could afford on unemployment benefits instead of trying to reposes our house. If you had paid your payment and your late fees and you have receipts I would go and talk to a lawyer. It doesn't sound right to me. Where i live there are all kinds of lawyers who won't charge for a consultation.

i don't know where you live, but some laws state that the landlord has to give you 30/ 60/ 90 days if you have children and if it's cold out. but you have a good case . if i was you, i'd get me a lawyer to represent me and take them to court. sue them for harrassment, ileagal eviction, the reason you all did'nt go to court was because you all do have proof that they are paid in full!so go on and get a lawyer and also see if he can get you all you have ask for and alsowhen you win this case, find a better place and not greedy landlords!!! i'm only assuming that part on why the case did't go to court. if they had a leg to stand on, you all would of went to court. they're only trying to bulldog you all and put some scare in you. they think you all will get tired of them tring to evict you to where you'll give in and pay them again. money IS the root of all evil. Don't Hire a lawyer -- it won't be cost effective. And it sounds like moving out won't be either.

The answer is simple -- read your lease and do what it says. Pay the $50 and nothing else. Say "no, it's not in the lease" to all BS fees.

Incidentally, the only way she can collect unpaid fees or even rent is to haul you to court. Make them do it. Search the web for specific laws in your area. Most won't for anything this small. Tenants fare well in court anyway. Throw you out for being late twice? that's absurd

Certainly WE are not strictly who you should be asking. Get with the people who claim you owe money to, then if you can't resolve the situation, get your own attorney.

I'd advise against accepting or waiting for Eviction. For one thing it may show up at some point on a credit reference report, if you attempt to rent again. At the very least, being evicted isn't in your best interest.

Did you get all receipts for your late charge ? Have you kept it in order? When you have paid and receipt is in your hand which state u did pay for it sit back and be calm the owner can't do much abt it. If your tenancy agreement read all the terms and conditions of it to make sure......

wait for them to evict you. Then take them to small claims court. You could also take them before the housing authorities.Most city have them.They can work it out for you. You don't have to pay $75.later fees,if you didn't sign any papers. Point that out to them.

It sounds to me like a horrible place to live. Is it possible to just find somewhere else to go? Once you're gone they aren't going to hassle you anymore. But, it seems to me if you're honest and tell people when payments are going to be late, ahead of time, they seem to treat you with a lot more respect. Good luck.

Can not sue for time off work. I think if like it. limp it ot move and if you wait, you'll loose your dp. And that is alot. Lawyers can answer if its a case or not for free. Good Luck and don't end up on Judge Judy
