You can file, but if you go to bankruptcy court they WILL ask you if you are in the middle of any claims/lawsuits that you could make a $$ from.

are you the plantiff or the defendant
if you get an award before court they will take it unless you wait a while and spend the $$
it really depends on what type you file for
