How do you find out if an Attorney you hired?took your settlement check?

I was in a bad ambulance accedent in 1984 and , I was the passenger (E.M.T. ) my driver had no licence,becuase he had seasures,(I did not know ) my attorny said I had to come to his offace to for my settelment check,when I got there he was rood and told me to get out and there was no check.But every once and awhile I run into people that worked at the ambulance company and they say it had to close becuase of my law suit and the owner told my sister I got a huge settelment? how can I find out if my attorny took my setelment.

It is completely unethical for your attorney to take your money (even if it was a check made out to him) and deposit it in his own account. He should place the money in a separate account for you until you are ready to claim it. I suggest contacting him again and, if he persists to refuse to work with you or give you any information and you ARE entitled to a settlement, then report him immediately to the state bar. Alternately, you can call the state bar and ask how you can check up on him for other unethical behavior.

If there was a lawsuit pending, any settlement (at least whether there was one) would need to be filed with the court.

You can also verify with the other party (or their insurance company) whether a settlement was paid.

If you determine that a settlement was paid, you can contact the state bar and notify them of the problem. If there was a settlement payment and attorney took it without telling you or paying you, that is grounds for disbarment.
