No, not really. The EEOC is the agency that the petitioner went to, and their (I think) statutorily-mandated directive is to oversee and make pronouncements on cases that bring to bear on this legislation, it's the Civil Rights Act but I don't know what sub-part of it.

Anyway, the EEOC issued a right-to-sue letter. The 9th Circuit Court of Appeals affirmed the District Court. The 9th is a big crapshoot, on any given day you can get any sort of complexion of justices hearing a case. But that's the 9th. It should be divided into two or three circuits. But, the EEOC issued a right-to-sue letter.

The decision reflected the complexion of the supreme court at that time, particularly Brennan, who may well have seen to it that he wrote the opinion. A person can't help reading between the lines a bit, I'm afraid.
