I think no one is bad they just "do" bad things sometimes. They may do it on pure inpulse.
Does that make them a bad person? No.
What makes some people look bad is the fact that they act un-remorseful at an act of violence they have comitted. They are too wrapped up in their own problems to come to terms with what they have done. Some don't know what to do or how to act. Even then some people do things to make themselves feel better it has nothing to do with the other person, only their own problems.

Unless there is compelling evidence of illness, we should assume the person is bad (that is, that they acted in the knowledge that what they were doing was immoral and criminal by community standards).

The alternative is to take the surely disastrous course of saying that all such crime (perhaps all crime at all) is 'illness' and requires treatment rather than punishment.

Of course, there is much philosophical debate about the purpose of punishment - whether it is meant to be revenge, or a disincentive to further crime, or therapy, or all three, or something else, but nobody claims we shouldn't punish crime at all.

In sum, the presumption should always be that a crime is due to badness rather than illness - unless illness can be clearly shown to be the cause.

The Stanley Kubrick movie 'A Clockwork Orange' is worth seeing in this regard (and, of course, because it's a great movie).

If it's violence to hurt someone else, yes. If it's the violence of your fist against the dashboard, thats part of letting off steam.
