I have been trying to get a divorce for 5 months now. When we went to a temorary hearing, my husband got visitation rights but child support has been held in abeyance. I need money to support my child. My child still has needs no matter how he and I feel about each other. He has never given a lot for her support but every little bit would help.

What was their reason for failing to determine child support? Why don't you contact the agency in your state that handles child support matters, they have nothing to do with divorce or custody issues they only do child support...here its called domestic relations, not sure if thats the same everywhere. They will determine and manage the amount of child support he will pay and tell you whether or not whats happening in divorce court has anything to do with it or not. Call them now and you'll have an answer in a few minutes.

Honey, I have no idea what "abeyance" is. I work closely with the court system and divorcing couples with children and I have never heard of this. If you needed the money, you should have spoke up at the hearing. Even if you didn't, it should have been ordered. The only way for you to possibly not receive it, is if you are on some sort of state aid. If that is the case, the state takes what they've paid you, or a portion of it, depending on your need, before they send you the remainder. Call your local child support Agency for more information. And re-read the minutes from your court hearing. I think you are not comprehending them correctly.

Have your lawyer present a motion to release child support. Provide proof of childs financial needs.
