My partner and I are due to marry, we have 3 kids. The 1st isn't biologically his but he has brought her up. Her real Dad didn't want to be involved and therefore is not on her birth certificate, nor does he have parental responsibilty. We can easily change the 2 youngest surname after marriage but as she isn't his biologically I can't just re- register her like I can the other 2. Does anyone know how I can give her the same surname as the rest of us, legally?

Yes I have ACTUALLY asked her and as she is only 6 years old she doesn't want to be the only one with a different name.

Firstly are you in the UK? If you are all you need to do in contact Deed Polls UK, you can do it all online, if you were never married to her bio father then you don't even need to ask him, it takes about 2 weeks and costs about £50, it is so simple... obviously then you have to change her passport, bank details, doctors, dentist, school but Dee Poll UK give you a template of a letter that you just send out to them all.... good luck in you uncoming wedding and all the very best to you and your family for the future xxx

Have him adopt her. The courts will require the biological father to give permission (easy way around this is to hound him for alimony and child support ). He'll give her over easy in lieu of the $$ and your man can take over the helm. Score! Good luck.

Your partner can adopt her or you could change her name by deed poll. They are both fairly simple procedures, i am in the middle of changing all of my childrens names back into my maiden name by deed poll. Just put deed poll into a search engine and check out the costings. Congratulations on getting married. Have a wonderful time. : )

hi ive have three children the same circumstancees as yourself, after consulting a solicitor he told me that if i had been married to the father before the birth it would be best to ask his permission as he could object and take me to court to appeal against it after i had changed it. Good news though it also goes in your favour if the absent parent has not had much contact or paid any maintenance. good luck

I did that with my daughter. I just went to my local courthouse and got the paperwork and had it noterized. If you are given a prob, your partrner could always legally adopt your other children. That is also grounds for a name change :)

dangle on Willa, you're incorrect! sure he has to agree, IF he has criminal parental duty. i substitute into married to my son's dad, divorced in 1999, son is 12, and that i'm no longer alllowed to alter son's surname to mine. i had to get my son to take my surname on his passport, and the passport workplace advised me i'd the two - a) take my ex husband to court docket over it b) pass to court docket on my own and have a look into and get a court docket order. c) get the dad to agree - yet i've got no longer even considered him for 10 years, and have no theory the place he's! He can substitute it himself whilst he's sixteen, yet no longer till now, so his passport and all his papers/information all have his father's surname, all by using fact of my short marriage 10 years in the past.

Since the real dad is not on the birth certificate, he can adopt her.

You have to see a judge to do it. Here in PA it costs about 500.00 to have a name changed. Good Luck and congrats.
