Can you people please give me more info on annulments. I have been married since April. We live in California, but got married in Las Vegas, Nevada. I love her so much and is soo painful for me to even think about this, but if I want to be happy in life I honestly think it won't be with her. I am 27 and she is 20. Yes, you can tell me thats my first mistake, but its to late to go back and change things.... How long can I wait to get an annulment instead of going through a divorce. And how do I go about getting it done. Does it cost money? Any info on annulments would be very helpful!!

First of all, you have to understand exactly what an annulment is.

While a divorce is a proceedure to discontinue an otherwise legal marriage, an annulment is a proceedure for declaring that a marriage is null and void. Divorces can be undertaken for pretty much any reason (irreconcilable differences, anyone?) but annulments will ONLY be granted for SPECIFIC reasons that courts are NOT flexable about. Simply, "I married the wrong person" isn't gonna be enough to get an annulment, I'm afraid.

Grounds for a marriage being voidable by an annulment vary based on jurisdiction, but are typically limited to fraud, bigamy, family relationship, and mental incompetence of one of the parties entering into the marriage.

Typical situations that will lead to the granting of annulments include:

-Either spouse was already married to someone else at the time of the marriage;
-Either spouse was too young to be married, or too young without required court or parental consent (unless, in some cases, where the marriage continued beyond the age of consent, which validates it);
-Either spouse was under the influence of drugs or alcohol at the time of the marriage;
-Either spouse was mentally incompetent at the time of the marriage;
-Consent to the marriage was based on fraud or force;
-Either spouse was physically incapable to be married (typically, inability to have sexual intercourse which persists) at the time of the marriage;
-The marriage is prohibited by law due to the blood relationship between the parties.

NOTE: THE ABOVE IS A DISCUSSION OF GENERAL LEGAL PRINCIPLES AND IS NOT TO BE CONSIDERED LEGAL ADVICE. CONTACT A LICENSED ATTORNEY IN YOUR JURISDICTION FOR MORE INFORMATION ON YOUR PARTICULAR SITUATION.
