The three branches are equal - Executive (President, etc), Legislative (Congress), and Judicial (Courts). That's what the system of checks and balances is all about - each branch has checks they can perform to make sure another branch doesn't get too powerful.

The Federal level. This includes the three branches of federal government: executive, legislative, and judicial. All three are different in scope (what they are responsible for) but equal in force of effect. The executive branch cannot pass laws (well, is not supposed to), the congress cannot enforce laws, and the judicial branch determines the legality of the law. Checks and balances. When it works right, it's a wonderful thing.

It used to be equally split between President Congress and The Supreme Court. More recently however the Supreme court has taken unto itself the power to create law rather than to merely judge on the constitutionality of law.
