She probably should have won. You have to keep in mind that McDonalds was selling really really really hot coffee out of a window in the side of the restaurant so that people could drink it in their car. McDonalds knew that not all cars are equiped with cup holders and that a logical place to put the cup is right between your legs. Now, most people would expect that the coffee that they buy to drink right away wouldn't be served at around a million degrees (McDonalds admitted that they served coffee extra hot to mask the flavor). We all remember this case because the verdict was huge, right? But the verdict was calculated by awarding the lady just one day's profit that McDonalds gets from the sale of coffee. We also know that she never saw all that money, but I am sure she made out just fine.
I like the point of your question, there are tons of stupid frivilous lawsuits filed everyday. There never seems to be a lack of bottom feeding attorneys that are willing to take on such cases either. The problem is that juries (meaning people like you and I and everyone that reads this) continue to award people for their stupid behavior. Until we learn that such behavior should not be rewarded, we will continue to see these stupid lawsuits.

I agree with leogirl! I use to stop at mcdonalds every morning and the coffee was WAY TO HOT! I got so peeved one morning I threw the chit out the window! There was absolutly no sense in serving coffee that hot! If I would have spilt the coffee on my lap I would have gotten so ticked off I probably would have beat the bejeesus out of the first person I found behind the counter! You couldnt even hold the cup it was so hot!

I thought the same way until I did some research on this particular case. McDonald's had had many complaints because of the temperature of the coffee was actually much too too hot. McDonald's ignored these numerous complaints. This is why the woman was successful in her suit, because McDonald's knew it had a problem, and did nothing to fix it. It however is surely fixed now.

Me and my fiancee got in a fight about this. Apparantly, the McDonalds did make their coffee too hot. And not just by opinion, but there are regulatory laws with a max temperature and that particular McDonalds was keeping their coffee hotter than it was allowed by law.
If she hadn't of received some god-awful burns I would totally be dogging the old cooter.
In fact, I used to, but mine eyes have been opened.
She shouldn't have received sooo much money though.

I'm not a lawyer, but I thought a judge could throw out a verdict if he/she decides that it is incompetent. I'm really surprised that if the disgression to throw out the verdict was available, it was not used in that case. I realize we have case law that determines precedents, but we really need to overhaul the entire justice system. Maybe implement an informal grievance/mediation procedure for frivolous law suits. Yes, very disturbing trend.
Had a close call recently, went to my downstairs neighbor at 2 am to ask him to turn off his stereo (I live in a condo assn and no noise is allowed after 10pm) and he laughed. I flipped out (did not enter his home, did not threaten him) but started cussing at him and told him to turn that bleeping sh*t off right now. The next day, the police showed up on MY doorstep, the jerk called the cops on ME for intimidating him. After a brief conversation, the policeman could see what was happening and told the neighbor that he'd have to keep it down and that he'd get a $180 ticket if he had to come back. World is getting turned upside down. Looking forward to reading other feedback.

here is the scoop.....McDonald's lost because it was proven in court that McDonald's knew their coffee was too hot and did nothing about.....multi-million dollar judgment against McDonald's.....on appeal McDonald's argued the lady wearing spandex shouldn't have placed her coffee cup between her legs....the judgment was reduced to one-hundred and eighty-three thousand dollars.........how much profit does McDonald's make per day on the sale of coffee??????????? $183,000.oo

If someone breaks into my house they are going to have bigger problems than worrying about suing me when they get hurt. Generally you have to be alive to sue.

if the lid was actually faulty then yes , it is very dangerous driving down the road with a cup of hot coffee with a faulty lid . but i really doubt it was faulty

I thought it was totally ridiculous. So now people are so stupid/anxious to sue someone we have to tell them things like "Coffee is hot". D-uh! This kind of thinking is what led to people suing McDonalds because the food was making them fat!
