when the man is out of the country. What is the way of getting a divorce from the wife who is in India, No offsprings from this marriage. the man had to flee from the torture by parents in law and wife.
If the man wants to join his mother and father in India. Can any criminal case be launched against him for leaving his wife 3 and half years ago ?

why did u flee from your wife & har parents in the first place ?you could have gone for the divorce then itself. you mean to say that your parents in law r in such a position that they can stop u from coming to inida ?why r u scared of them ? did u do anything wrong like demanding dowry or torturing your wife ( u know people try to burn their wives alive still in india )if u don't have any criminal records against you then come back, file for a divorce. of cource u may have to give compensation to your wife for deserting her so long.& u may have to give her alimoney.

as per the Indian Hindu law once married the husband cannot leave his wife with out any reasons.
If husband is not taking care of his wife he can be fixed in false cases.
If he want to leave his wife it is only through divorce.
to get divorce there are number of grounds. if one or more them are fulfilled then only husband can leave his wife as per the directions of the courts.
Better conslut lawyer.

Get a lawyer and send her the papers if she doesn't sign then take it to the courts to get it done. There is no crime in leaving your wife, may have some issues if bills where in your name but you can take care of that in the divorce papers. She has probably gotten on with her life. Have your parents contact a lawyer in that state or you can contact a lawyer where ever you are and ask them.

I don't know about the laws in India but in the USA that is abandonment and that would make the divorce your fault and you would be responsible for all of the costs of the divorce as well as paying alimony.
