At first for the children the agreement was i would pay the mortgage instead of child support, but now child support has been issued and she wont pay me rent or leave.Which shes been living there for free for 2years now, along with her parents and other two kids. But if i dont pay the mortgage(which is only in my name) it will foreclose. So how do i get her to sign a rental agreement or how do i get her out??

U may have to get a "pay or quit" notice and give her 30 days to either pay or be evicted. Or u can get a "30 day notice of termination of tenancy" . U can get these forms at your local district courthouse or go online and get the downloadable forms. U will have to pay a small fee, I don't know about your state but where I live it's about $100 (on line is cheaper), but it will do what you're trying to accomplish.

Basically u can't just kick her out. U have to treat her as a tenant and will have to get the proper forms to evict her.

Get an eviction notice and forget about the rent. Chalk it up to an expensive lesson learned.
Rent the house to someone who will pay the rent.

You cant make her pay for anything that you already paid unless you get her to sign something. The best thing to do would be to ask your lawyer if you can get her evicted, if she has no name on that house and doesn't have a contract with you then she has no right to stay.

If she dosent agree to pay you after you talked with her tell her you are going to start eviction preceedings. Her parents should also be part of the conversation..they are taking advantage of you.. If you never agreed to let them live ther yo can give them a weeks notice to leave..Did you bring this up in court..I think you also need a new court date.

theres not really much you can do about the last 2 years of payments she owes you unless you signed a contact...
to fix the problem maybe you should look for another place to live it would just make things so much easier going through law would be costly and would take a long time

Simple: Evict her like any other common whore--oops.

BTW, just because the morgage is in your name doesn't necessarily mean the house (or payments) are soley yours. Didn't the agreement cover it? E-mail me the details. Different jurisdictions have different laws, but I have some experience in this area of law.

Just inform her of the forclosure situation and give her the option to either (a) move out or (b) pay rent.

go to the sheriffs office and issue and eviction notice, she will then have 30 days from the day issued after that you can have them put on the street

depends, which state so you reside in? different states have differing laws regarding poor tenants.
