At first for the children the agreement was i would pay the mortgage instead of child support, but now child support has been issued and she wont pay me rent or leave.Which shes been living there for free for 2years now, along with her parents and other two kids. But if i dont pay the mortgage(which is only in my name) it will foreclose. So how do i get her to sign a rental agreement or how do i get her out??

U may have to get a "pay or quit" notice and give her 30 days to either pay or be evicted. Or u can get a "30 day notice of termination of tenancy" . U can get these forms at your local courthouse or go online and get the downloadable forms. U will have to pay a small fee but it will do what you're trying to accomplish.
Basically u can't just kick her out. U have to treat her as a tenant and will have to get the proper forms to evict her.

Tell her straight up that since the agreement was broken and you now pay her child support that she and her freeloading parents have to either pay you rent or help meet the monthly mortgage or you will start proceedings to evict them and let her know if need be you will take your child its as simple as that.

you don't, when they all leave change the locks and don't let them in. when they show up call the police and have the police remove they're property. always have a witness around so that she can't say you did something to her. you can also take it further by getting a restraining order against her. if the house is in your name the above is possible. it will be hard for the kid, but after the dust settles that will all straighten itself out. i can't believe you let this go for so long, women get all the breaks in courts, so you need to stop this rediculous crap now. no longer will she take advantage of you. no more. good luck and don't you dare give in, no matter how much crying you see, and tell her parents to get there own place for the love of god that whole family is using you.

Just start politely setting her things out on the lawn, she'll get the clue. And thats not illegal because she doesnt have a lease with you so hey!

I SSUE HER WITH A NOTICE OF ACTION, EXPLAIN SHE IS RECEIVING CHILD SUPPORT AND ITS NOT HER BUSSINESS THE REASON WHY YOU NEED TO CHARGE RENT , SO JUST EXPLAIN THE DATE AS OOF WICH SHE NEEDS TO PAY A LUM SUM. OF RENT EVERY MONTH.
