There's financial ties and a unborn child involved as well.....

So much good advice and info....it's impossible to thank each individual seperately! So thank you to everyone who has responded so far! Every bit of input helps.

Someone asked about the age, assests, and location....the ages are 32 and 33, assests include a house, cars, and some accounts, and the location is in Texas. Also, the two involved have been married for around 11 years (sounds impressive, but the reality is not so enviable.)

I think there will be a DNA test done when the baby is born (as suggested by a few individuals) but most likely, the baby is husband's child. It's all so complicated but thanks for helping to give some direction!

If you are pregnant most states will not let the divorce be filed until the child is born. This is to ward off any paternity issues. My first divorce was complicated. There was our child, and he was in jail for theft. It took over a year and $5000. My last divorce was very simple. He filed Feb. 14, and it was finalized April 6. No children involved, no contest. We didn't even have to go to court for it since we both agreed on everything.

Since you have an unborn child first off you probably won't be able to file for it in the first place, and secondly it will take many months due to sorting everything out...who gets what, etc.

Not likely with a baby on the way honey, even if you tried to wave the cooling off period of 90 days. Courts are going to have to award visitation and set child support, not to mention decide who is covering the costs, etc. They can't do this until the baby arrives and schedules are put into play. And it will need to be resolved before the final order is issued.The financial ties will also complicate things. It would be easier for everyone involved if you just remained separated during this time and figure everything else out after the baby arrives.

I had mine in about a month we both agreed to it no fights etc. no court just did the process ourselves and got divorced in Florida. Is less expensive that way took me awhile to talk them into it. I did it twice they were not good to me so I talked them into it because it is easier if they agree than if I go to court with a long legal battle.
If you both agree it can be done easily but you have to fill out some long extensive legal documents at the court house. If he agrees to all of it and you all work it out including the financial stuff it is fast and easy. There is alot to it. If you cannot afford it check into legal services to help you with it if it is related to abuse etc.
In Florida it is also the 30 day separation thing before it goes through then you go back to court and if you do not disagree they give you the divorce papers. Keep the copies and get more copies because you may need them for other things. I believe if you stay married to him regardless of who the father is legally he becomes the father from what I understand unless he contests or something.
Foreign divorces are often not recognized in the U.S. because couples use to use this for tax reasons then remarry again in Mexico.

Mediation is where you divide up everything with an attorney and then they help you file the paper work. If your not fighting about anything then you really should be able to file and get a date within a month. Depending on the state and the courts back log.

Not in Missouri. In Missouri they will not let a couple divorce with an unborn child. You will have to wait until the baby is born.

Not with a baby due.. If its not his maybe!
u can go and file the paperwork at the court house
yourself, then they serve him and if he agree's to everything, it can go one two three!!!
P.s draw back is he has to agree that u have been seperated at least 6 months and don't own property such as a house....

It depends on what State you live in. I live in Missouri and my divorce took only 30 days. In my State you just have to be seperated for 30 days before you go to court. So, if you get an early enough court day (as I did) you can get it over with quickly. My court date was set for the day after the 30 day seperation period.

in your case no may be so if the both of you get the paper work down but i don't know what is going on but think the baby has to have a mom and a dad maybe it will work after the baby here give it time i think you maybe still mad good luck to you

90 days in the state of Washington is how long it takes after the paper work has been filed. I'm sure that in other states there is a waiting period as well.
