has the last name of who shes divorcing does he have any ritgs too the baby if your in arkansas i mean whats the law?

The bi logical father has rights.

If the guy the mother is divorcing is not the child's DNA, but has the last name on the certificate, doesn't have rights. A mother can place any last name on birth certificate just as any other name on it.

I have the same last name as my siblings, even though he isn't my dad. He has no claim on me. When he refused to give my siblings and I back ("my kids, I have rights to them" type thing). My mom told the cops I wasn't his and then that became a "kidnapping" if he refused to give me back.

I don't know about Arkansas, but in Washington if your married then the child is automatically thought of as the current husbands if it was conceived during the marriage. Once they are divorced the then ex husband will have to order a DNA test and go to court to prove that the child is not his. The mother can order the testing as well.

It's nice you want to help out your sister-in -law,but the best thing to do is consult a lawyer, Most states consider the husband and wife parents of a child of that marriage even if he is not the biological father. The courts are concerned with the child's welfare not who the "real" father is. It's going to take some court time to figure your situation out> Good Luck!

The only parents who have a claim on the child are the birth father and mother. The exhusband of the mother would have no claims on the child, esepcially if the baby was born during the divorce process.

No, the divorced father has no rights to this child what so ever and will more than likely step aside so that the baby's name can be changed and he isn't responsible for child support.

It depends if the not real father adopted her during the marriage. If he did then he had the right to the baby.

Boy your sister in law missed up big time. Hopefully it is a learning experience for her not to play with others emotions and respect her vows when she committed herself to being married to him. You wonder why men go crazy when things happenned like this.

yes he does. if he helped raised that child in anyway and paid for things for that child then yes he would. why couldnt you just sleep with your husband instead of being a whore? you've ruined your ex husbands life, nice job

Why would he want to? Make sure the sperm donor pays the support.
