I live in Va and i have a neighbor that is constantly harassing my family when I away. Even sometimes when i return he or his wife is calling my house or trying to tell my kids where they can and can't play. As i've spoken to him about this in the pass the sidewalk is consider public property. Because i goes infront of his house (the neigbhor hood has a one side sidewalk that goes completely around the lake on the Left side) this does not allow him to control who can and cannot play on this portion of the sidewalk. I've really feed up with this type of constant harrassment from him and his family. They are trying to be trolls of the neighborhood. I have not had a problem with any of the neighbors around me just this one. I've tried to be reasonable and keep my kids from playing in or around his area, but this has gotten out of hand. Any help you can provide would be appreciated. Thanks.

Is he an older gentleman? Could he be lonely? Maybe what he's doing is the only way he can interact with people. If not, you might want to enlist the help of either the other neighbors, or worst case scenario, the police. Does he have a specific concern, like he's afraid the kids are going to break a window or damage his property? Listen to him, and then agree to some sort of compromise. It's hard to live next door to someone under the restrictions of a restraining order.

I know sometimes it can be just someone being an @sshole but maybe when you are away your kids are being really loud and bothering them. I know it is a public sidewalk but you know what I am saying. At least you have told your kids to stay away from there but it sounds like they are not listening as you are still having a problem. The best thing to do is leave these people alone and stay away from them. Tell your kids to stay away from their house and mean it this time. If they dont listen then there is a problem.

You cant get a restraining order unless you feel threatened by someone. Simply because you and your neighbor clash isnt good enough reason.

Like i said, just keep away from them and let them be miserable about something else.

Mr. Virginia,

Most states only allow a person to obtain a Civil Protection Order (CPO) or Temporary Protection Order (TPO) if the Petitioner feels physically threatened. In Ohio, once the CPO is filed, the Court conducts a hearing in front of a Judge or Magistrate to determine if the accusations are credible. Consult with a representative of your local Court system for further information.

you could pass for a restraining order at any time against every person, whether you will desire to have a sturdy sufficient argument to convince the decide to go into it. It seems such as you have been in touch with the mummy of the former lady buddy and with the final room mate. in case you could desire to get them to testify, which would be sufficient to convince the decide to go into the restraining order. whether, whether you get a restraining order, getting the police that may additionally assist you in enforcing it extremely is yet another conflict you will would desire to combat. they're going to generally no longer take any action by using fact the guy whom the restraining order is against has no longer broken the letter of the order, even however what they have completed is intimidating, frightening and harassing. i'd propose consulting with a criminal expert who focuses on kinfolk regulation, fairly in kinfolk violence concerns. They very properly would provide you an preliminary consultation for unfastened, the place they provides you with their opinion to whether or no longer they think of you have sufficient evidence to get the order, whether the testimony of the others you point out will help, and so on.
