That all depends on where you are. Some places it is, some places it's not. Details in a question like this would help us answer your question. As your question is worded right now, the answer is:
Maybe, maybe not.
EDIT:
Okay, now that we know where you are, let's see. In Massachusetts, 16 is the legal age of consent. So, in theory, you should be fine. But as it turns out, there is a law in Mass. about "Inducing a person under 18 to engage in sexual intercourse". The best I can tell, that means if she claims later that you seduced her and she was a virgin before that, you're in trouble. You can do up to three years in prison for that one. And there is also a law in Mass. against "fornication". That means that, technically, having sex with anyone you are not married to is a crime. It's a minor one, but a crime, nonetheless. You could end up with 3 months in jail if they really want to push the issue.

You have not mentioned the name of your country. In Australia and India, it is not a rape because the age of the girl is 16 years. But in other countries, it might be a statutory rape, as the intercourse with a minor girl "with or without her consent" is a rape if she made a complaint. But it is not a rape in absence of such complaint.
