There are thousands of frivolous lawsuits filed each year, but there are a number of safeguards which gets these suits dismissed early in the litigation process. Most frivolous suits will not come close to making it to trial. I think the perception is inaccurate because of the media coverage of lawsuits that do make it to trial that people think shouldn't have. For example, people will site the "McDonald's coffee" case as a case that should have never been filed. That was a legitimate case. The coffee served to that woman gave her third degree burns. The coffee was way too hot and caused serious medical problems to an elderly woman. Was she an idiot for holding it between her legs? Absolutely. However, in most states, the law takes the plaintiff's stupidity into consideration (comparative / contributory negligence) and will reduce the plaintiff's award by the percentage of fault attributable to the plaintiff.

Lawsuits are not cheap to maintain. Filing fees, depositions, attorney's fees, etc. quickly add up. I think the majority of people would rather resolve issues outside of a court room. It's the coverage of the few crazy lawsuits that have created the misconception.

It is hyperbole, based on the fact that many lawsuits that seem irrational at first (or even second or third) glance are allowed to proceed.

But it's also true that far too many people spend far too much time fighting legal battles, rather than attempting to resolve disputes through other less-adversarial means.

I see a lot of it where I live, but I think it is pretty much isolated to certain societies. I've never seen this much activity anywhere but here and the original home of many who relocated here.
