Please Help!

About 2 years ago i rear-ended a company vehicle while driving my sister's car. She did not have insurance and the company claimed it on theirs. The company sent me a letter regarding collection of damages back in 2004. I agreed to it over the phone w/ one of their reps.

That was the last I heard of them until about a week ago when i got a letter regarding a court date(09/18) to seek damages the insurance company is trying to collect. I do not understand why they would involve the courts regarding this matter when it could be solved out of court. There was little attempt to collect anything & there was only a verbal agreement for me to pay them for the damages..i did not sign any contract regarding the damages. I would have fulfilled my obligation if i did.

What are my options for this? Now not only do i have to pay for the damaged vehicle but now also court costs as well as attorney fees! ANY info is gladly appreciated & god bless you for any advice that

why don't you call the company and tell them that you would like to make arrangements to make payments. It usually helps to try and talk with them first.

Sounds like the usual mis-communications between insurance companies, adjusters, & attorneys. This is why you should confirm everything in writing & keep copies. You can call the attorney; tell them that you had offered to settle earlier & you want to enter into a payment agreement. This time: record names & phone numbers & get it in writing! And do not let the court date slip by before doing so. Go to court if you have to & explain it to the judge.

You have to appear in court. Ask for a continuence, then try and deal direct with the insurance company.
