i went to the Dr's yesterday for a physical. He prescribed me some generic antibiotics when i asked him that i wanted the name brand stuff he told me that there was no difference. I told him i didnt care and i wanted the name brand stuff and he continued to tell me no that the generic stuff will do. Why did he deny me my right for a premium brand medicine can he legaly do that to me?

Doctors can do anything . . . they're GOD!

But I think that a prescription is written for the drug, and the pharmacist can ask if you want the lesser brand, i.e., the generic.

Talk to the pharmacist about this, and see if they'll sell you the non-generic of the prescribed medication.

Absolutely YES! He not only can he did, You have the option to change doctors. If on the other hand you are not paying the full load, insurance subsidized, The next guy is going to tell you the same thing. Some Insurance companies do allow you the premium brand but don't cover the difference in price as compared to the Generic. Why would you want to pay more for the same thing anyways.

He can't deny you that. You should be able to tell the pharmacy when you pick up your prescription that you want the name brand stuff because when the doctor signs the prescription for generic, it means he will opt for generic or name-brand. If he signs only on the name-brand then he does not allow the generic. HOWEVER, if you have insurance or are covered by state aid of any kind, they will probably only pay the generic prescription (which might be why the doctor signed it that way). So either you will have to pay the difference or you may get stuck with the whole bill for the prescription!

Why would you want to pay for a name brand when the generic is EXACTLY the same thing. Most times, the generic drugs are made by the same companies that make the name brand of the same drug. Your insurance company might not pay for the name brand and the doctor probably knows that.

If you are unhappy with your doctor's care, you should switch doctors. Some pharmacies will automatically give you a generic med if it is available unless the doctor specifies. Some insurances won't pay for name brand meds when generics are available. The only difference is that you are paying for the name. Generics are just as effective as "premium" brands.

it may be that the insurance company will not pay as much for name brand.
really the difference is only manufacturer. the doctor should follow your request, as a rule. he will note on a Rx that the name bran is patient requested and you will have to pay a higher premium.

You can ask, but ultimately the doctor is the one writing the presciption and you can't tell him what to write it for. Your alternative is to go to another doctor.
