will they look for us or will we be able to start a life in another state with out them trying to take my kids. i dont want no trouble and its only cause their dad will not leave us alone he drinks and gets violent but i dont have him around and they still want my kids what can i do to keep them legally?

You need to find out what kind of services they want you to do if any. You also need to find out what the meaning of "open" is. Does that mean they are just investigating at this time. Or does it mean they found something "wrong" in the home and want you to correct the problem. What ever you do, don't just pick up and leave. This could tell them you are not cooperative. You may want to get a restraining order against their dad and prove to them you are doing what you need to do to protect your kids. If These usually do not cost much money. DCFS should be able to help you with this. You need to work "with" DCFS not against them or they can and will legally take your children.
If you just pack up and leave they can and will find out where you went and then the other state can automatically take custody of your children if they feel you are danger to them.

Your best bet would be to contact the DCFS and advise them that the father of the children is no longer residing in the house with them as well as the fact that you are moving out of state. Get a name and an employee number of the person that you are talking to and write down what you discussed with them (date and time).

Let them tell you what the next step would be. It's best for you to get this resolved before you leave.

Try to get a temporary restraining order against him since he is violent and an alcoholic and try to get permanent custody in court they will asign you a phycologist and might let you keep the kids in another state if he doesnt have visitation rights. If both parents wants custody they will award custody to the parent that lives in the state the kids were born. My sister in law has a 5 year old she had shared custody and the dad used to see him every other weekend, she moved with the kid to another state and the dad went to court to ask for sole custody and they gave it to him because the kid was born here in NY, they sent her a letter to our house where she was living saying that she couldnt leave the state with the kid or she was going to loose custudy and she did.

YOUR NOT TELLING THE WHOLE STORY HERE........if there is a open case against you then no you cant move the children and if you do then its you that is running from something. no state is going to take your children just because there father is an idiot. the police well take care of a violent drunk...if you want to move to another state all you have to do is get a court order from a judge. if the father is that bad and you have done nothing wrong then the judge well be glad to let you move.

Each county of each state has an office of the department of child services. If you move out of county or state where you are currently under investigation, it is possible that the office may inform the office of the new county of the allegations.

well if they havent come over i would call them and say hey my alcoholic [kids parent, babies daddy, husband] is really getting out of hand so im moving far away any problems?
