I'm not eligible for FMLA (Family Medica Leave Act) because my employer doesn't have 50 employees employed by them. Are there any other leave that I can be eligible for? What are the laws for maternity leave? Do I keep my insurance while I'm on maternity leave, do I still receive my benefits etc...

Certain states will offer a short term disability for this reason. You will keep your insurance during your maternity leave unless you don't pay the premium. Your best bet would be to check the legislation for this in your state.

you can still get disabilty payment but because they have under the 50 employees they do not have to hold your job while your out that is basicly whe the fmla does it holds your job. Your insurance will expire in thirty days from when you leave unless you pay the cobra premium which you should receive a copy of every year from your job as to what the amount would be.

My Admin person is going out on maternity leave soon. She will be keeping her insurance but she has to pay the premiums. She will not be accruing sick or vacation time while she is out. Her job will be waiting for her when she comes back. We do not have 50 employees either.

I dont know what state your in But
I had my maternity leave in Virginia , an I used my Short term Disability for the time i was off. Yes you do get to keep you INC.
Check with you HR person they should be able to Help you alot more. An if you dont have a HR .. ask you boss who to speak to.

u need to ask these questions to ur employer cause the answers vary when it comes to diferent companies. for example, i dont get maternity leave or family leave (which are both unpaid) at my job due to not bein here a year but i do qualify for short-term disability (whichis 60% of my pay) that gives me up to13wks to recover. and they are goin to continue to cover me under their insurance policy but since i wont be bein paid by them due to bein on leave and the insurance pays me, i have to send in my share of the insurance cost each month. but this company wouldnt usually do this if u havent been with the company atleast a year but the owner and my mother are friends so im getting special treatment u can say.

You lose your insurance after days but they will offer you COBRA which is where you pay a whole lot of money to keep your insurance, that's how it works here is Califonia anyways. The only thing you are eligible for is disability.

I guess I was wrong I thought it didn't matter if how any employees that company had I thought your time at the company (1year) effected your FMLA.I took one last year and they held my Job and I kept my insurance.I only took 7 weeks but you can take up to 12 weeks. most states give you disability for your leave which only pays you a certain percent of you income you get six weeks for normal delivery and eight weeks for c- section. for your medical it's up to your employer if they want to keep paying for it if not you are responsable for making the mothly payments. in my case i chosse to pay for it but i never had to see a doctor while i was out so the sent me a letter saying i didn't own anything. all prenatel and post natel apointments are free hope this helped alittle

i'm pretty sure the co. store i work in doesn't have 50 employees and i took maternity leave (unpaid though so i ended up taking my vacation pay to supplement my income.)
