Absolutely. Article 1 Section 8 of the constitution gives Congress the power to hire mercenaries.
To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;

Yes it is. They are called "contractors" now. Iraq is full of them, working security for oil companies mostly.
