Two years ago my sister who was a single parent to 4 children had gotton some help from a foster father for her 2 boys, he was to be their mentor. The foster father/mentor and the boyfriend of the foster father molested the boys. It went to court and the men were imprisoned. My sister was devastated for trusting what she thought was a state certified foster father.
The boys had problems in school, sleeping, trusting....many problems. My sister was under so much stress with all the appointments with physcolgists, Doctors, school....she became ill and went on assistance (Medicade) to help with all the medical bills. My sister was just diagnosed with cervical cancer a few weeks ago and now just received noticed that they were cancelling her medicade. Now that she has been diagnosed with cancer she will never be able to get insurance and that is a death sentence for her. THE STATE EMPLOYED A PERVERT TO RAPE her boys and stopped her medicade AFTER a cancer diagnosis. Any advice? Legal?

Unfortunately, there is no connection between the two to give her a stronger case. But I doubt if you could prove her cancer was caused by the foster father's boyfriend. (I would have been leary right from there). The state does not guarantee that the foster parent you end up with is actually going to be of any help so I don't think there's any legal recourse outside of what was already taken.
As for the medicaid- Tell her to contact her representative in Washington and her senators as well. They will have far more access to info that might help your sister.
Sorry to hear about all the crummy luck. Hope things turn around- I'll keep her in my prayers.

She would have to sue Social Services who assigned her these perverted foster fathers without rigorous background checks and screenings. That will take years.

America has appeals process for a reason - the decision to cancel Medicaid should be appealed and a strong lawyer needs to invoke discovery to ensure that retribution was not the sole reason for discontinuing her benefits.

Unless there is more to the story - those two legal cases need to be set in motion NOW. Maybe a phone call to the media might help in exposing this case to the light of day. This needs to begin NOW as well.

You are talking apples and oranges here. On one hand you have the issue with the boys - terrible, yes - but back up a little...your sister went on welfare because she was ill (stressed). So, she is getting welfare for being stressed. Crap! I am stressed, I wonder if I can get welfare. Totally besides the point but - if she was being removed for one reason, she can be added for another. Don't panic and start pointing fingers at the very same state you now want to support your sister and her family. Simply reapply for benefits using the cancer as the new reason. Sounds better than stress anyway.

1 of those times I wish I was a lawyer/solicitor I'd give 'em what 4 on Moral grounds alone.

That is terrible! I am so sorry! I suffered abuse as a child also, and I think she should get an attourney and go to higher courts(supreme) against her state and sue for her anguish and her childrens'. The state can charge us with offenses, even though it is only the judge who represents the state, or "the people." She needs to seek higher authority and fight for her childrens sake and for her life, agains her state or against her old medicaid, if they had an illegitimate reason for cancling her. She really should get a good attourney and ask, though that can be very expensive, I hope she works through this.

They have some kind of free lawyers for people like her. If that doesn't work, she should call the television station. They would LOVE to have a feature like that on their news programs!!

I would suggest having her go to Social Security in person to file for Disability. Please have her bring documentation . Also,to cover herself,go to your local Congress representative and explai your situation to see if the Congressperson can help with medication or help get Medicaide get reinstated. Good luck.

i dont think they can cancel Medicaid can they i though it was a support thing. but hmm you might be able to sue for negligence against the state maybe but if the gay foster molester hid everything they cannot be held libel

She might be eligible for Social Security. She needs legal help.
